The POPI Act

Tomorrow, 1 July 2021,  changes to South Africa’s Protection of Personal Information Act (PoPIA or the POPI Act) come into effect.  This act sets out conditions for responsible parties (“controllers” in other jurisdictions) to lawfully process personal information of data subjects (both natural and juristic persons – often the customer or client).
There is a section of the Act that specifically deals with Direct Marketing in any form. This is Section 69, which outlaws direct marketing in all electronic communications unless the data subject has given their consent to receive such communications, this includes all electronic communication such as emails, SMS, and automatic calling machines.
